By accessing or using SafePinQR.com ("SafePinQR", "the Service", "we", "us", or "our"), a service operated by 2381467 Ontario Inc., you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all visitors, registered users, and anyone who interacts with the Service, including third parties who scan a SafePinQR sticker.
SafePinQR provides a vehicle emergency alert system. Registered users affix QR code stickers to their vehicles. When a sticker is scanned by a bystander or first responder, the Service sends SMS and email notifications to the vehicle owner's pre-designated emergency contacts.

You must be at least 18 years of age to register for and use SafePinQR. By creating an account, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.
SafePinQR is intended for use in Canada and the United States. Use of the Service from other jurisdictions is at your own risk and subject to local laws.
To use the Service, you must create an account by providing accurate, complete, and current information. You are responsible for:

By entering emergency contact information (names, phone numbers, and email addresses), you represent and warrant that:
SafePinQR is not responsible for failed alert deliveries due to incorrect contact information, opted-out phone numbers, or full email inboxes.
SafePinQR operates on a prepaid credit model. Credits are purchased via Stripe and are used to send emergency alert notifications. Pricing is displayed at the time of purchase on our website.
All purchases are final and non-refundable, except where required by applicable law (including Canadian consumer protection legislation). If you believe a charge is in error, contact us within 30 days at support@safepinqr.com.
Purchased credits do not expire as long as your account remains active. Credits are forfeited upon account termination.
All payments are processed by Stripe. SafePinQR does not store your payment card information. By making a purchase, you also agree to Stripe's Terms of Service.
QR code sticker PDFs are generated upon successful payment and delivered digitally. You are responsible for printing and affixing stickers to your vehicle(s).

SafePinQR allows any person who scans a QR sticker to trigger an emergency alert without creating an account. By using the Service, you acknowledge and agree that:
SafePinQR is a notification tool only. It is not a substitute for calling 911 or other emergency services. In any emergency, always contact appropriate emergency services first.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
SafePinQR does not warrant that: (a) the Service will be uninterrupted, error-free, or available at any particular time; (b) emergency alerts will be delivered successfully in every circumstance; or (c) the Service will prevent injury, death, vehicle theft, or any other harm.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAFEPINQR AND ITS OWNERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
(a) Loss of life, personal injury, or property damage; (b) Failed or delayed alert delivery; (c) Unauthorized access to your account or emergency contact data; (d) Any outcome resulting from a third party scanning your QR sticker.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM. IN JURISDICTIONS THAT DO NOT ALLOW EXCLUSION OF CERTAIN WARRANTIES OR LIMITATIONS OF LIABILITY, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless SafePinQR and its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended personal, non-commercial purpose. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written consent.
Your use of SafePinQR is also governed by our Privacy Policy, available at safepinqr.com/privacy-policy.html. The Privacy Policy is incorporated into these Terms by reference.

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles.
Any dispute arising from these Terms or your use of the Service shall first be addressed through good-faith negotiation by contacting us at support@safepinqr.com. If unresolved, disputes shall be submitted to the courts of competent jurisdiction in Ontario, Canada.
U.S. users retain the right to bring claims in their local jurisdiction where required by applicable consumer protection law.
We may update these Terms at any time. When we do, we will revise the "Last Updated" date above. For material changes, registered users will be notified by email.
Your continued use of SafePinQR after changes are posted constitutes acceptance of the revised Terms.

SafePinQR provides a community-based support tool designed to assist in emergency and identification scenarios. Our services rely on third-party systems, user-provided information, and external communication networks, which are beyond our direct control.
SafePinQR does not guarantee the successful delivery, transmission, or receipt of any messages, alerts, emails, or notifications generated through the use of our platform. Delivery may be affected by factors including, but not limited to, network outages, carrier restrictions, spam filters, incorrect user input, or technical failures.
To the fullest extent permitted by applicable law, SafePinQR, its owners, affiliates, partners, employees, and representatives shall not be held liable for any direct, indirect, incidental, consequential, or special damages arising from or related to the use or inability to use our services, including but not limited to failed communications, delays, or inaccuracies.
Users are solely responsible for ensuring that all information provided is accurate, complete, and up to date. Users acknowledge that SafePinQR is a supplementary tool and should not be relied upon as the sole method for emergency communication or personal safety.
By purchasing or using SafePinQR services, you expressly assume all risks associated with their use and agree to release, discharge, and hold harmless SafePinQR and all associated parties from any and all claims, demands, or causes of action, whether known or unknown, arising out of or in any way connected with your use of the platform.
